If you have been a sole trader operating a small bar or similar business and
you do not resolve the business correctly you will still be liable for social security
payments, taxes and contractual obligations under the terms of your lease or rental
contract. Sadly many people simply hand in the keys and walk away. This is not
advisable as many landlords will chase you through the courts in the UK. It is
preferred to settle your obligations correctly and attempt to agree with your landlord
to dissolve the lease and hand the property back. Most landlords will agree to this
rather than be left with a property that they cannot lease until going through the
lengthy court process of gaining access to the premises.
Other considerations you should think about are loans, credit cards and hire
purchase agreements as these are likely to follow you back to the UK in the form of
court actions and poor credit rating
Our English Solicitor and Spanish Abogado together with our legal team,
accountants and tax specialists can best advice you on your individual situation so
that your move back to the UK goes without further legal or financial implications in
the future. This is especially important if you are to return to Spain in the future.

Remember it can take some time to resolve these issues so allow plenty of time
before returning to the UK to begin winding things up in Spain, especially if you are in
financial difficulties. It is advised to solve these issues rather than just heading home
as they will come back to bite you at some time in the future.
commitments. This is especially true for those who have property, business,
contractual obligations, mortgages and other financial and Tax obligations.
New rules and easier legislation across many European Union members
have made it much easier for creditors and tax revenue authorites to initiate
cross-border actions and recoup debts in other European Union countries.
So that legal commitments do not come back to haunt you it is vital
that you get proper advice from a Solicitor so that leases on premises,
mortgages and loans can be dealt with and resolved correctly.
If you have incorporated or administered a Spanish company, there
are mercantile and taxation issues which should be resolved in order to
avoid unnecessary liabilities. It is important to follow the correct procedures
for the cessation of the company. Failure to do so will leave the company
“alive” making it and you prone to possible court claims and subject to
continue to comply with all tax and legal obligations.
