Property Purchase and Sales - Advice on buying property in Spain
For most people moving to Spain, buying a property is the single largest and risky transaction they are likely to
take. Great care should be taken to ensure that your best interests as a buyer are taken into account with some
very easy to apply rules!
1. Do not use the same legal team as the seller.
2. Do not use a legal team who work with or are associated with the Agent you are buying through.
3. If you are not present on the day of the sale and are giving a "power of attorney" to someone It is important not
to authorise the agent, representative of the seller or representative of a bank to complete the sale on your behalf,
as they are not independent and will not be representing your interests.
4. Never be talked into parting with cash "black money" by agents or sellers. It is not the buyers responsibility to
pay agents fees! The deed should clearly state 100% of the price you are actually paying for the property.
Once the initial checks have been made to ensure the title of the property is in order, the property follows local
planning regulations etc, you will be required to pay a deposit. Property sale in Spain are all completed before a
Notary. The document (deeds) you will sign is called the Escritura Pública de Compreventa.
